1. Introduction
These Terms and Conditions establish a legally binding agreement between:
(a) MadridTourExperience (“We,” “us,” or “our”); and
(b) any individual or entity (“You”) that accesses and utilizes the MadridTourExperience platform available via the www.MadridTourExperience.com website and its subdomains (the “Site”) to search for and/or book sightseeing tours, activities, and related services (the “Tours”), and/or participates in tours booked through MadridTourExperience and/or the Site.
2. Acceptance of These Terms and Conditions
By accessing and using the Site or participating in a Tour, you confirm that:
(a) You have read, understood, and agree to comply with these Terms and Conditions;
(b) You are at least 18 years old, or a validly existing business, organization, or legal entity in good standing under the laws of your country;
(c) You can enter into legally binding contracts;
(d) You are not prohibited by MadridTourExperience from accessing and/or using the Site; and
(e) If you bring additional participants to your Tour, you ensure that they have read and agreed to these Terms and Conditions.
If you do not agree to these Terms and Conditions, please refrain from accessing or using the Site and do not participate in any Tour. These Terms and Conditions should be read alongside the Cancellation Policy and Privacy Policy.
3. Scope of MadridTourExperience Services
We provide an online marketplace platform that supplies tailor made tours and experiences abroad, and allows you to search, book, and review Tours. You may connect directly with Suppliers through the Site to conclude contracts.
4. User
You may search for Tours without registration, but booking may require registration and profile completion. MadridTourExperience reserves the right to refuse or cancel bookings at our discretion. You are responsible for providing accurate information and maintaining it on your profile.
5. Booking
Tours listed on the Site are invitations for you to make an offer to a Supplier, except for last-minute bookings. Once a booking is accepted by the Supplier, a binding contract is established. You are bound by the Tour Terms upon acceptance.
6. Payment and Currency
Tour prices are set in US dollars. Payments must be made through the Site or as determined by MadridTourExperience. We do not store credit card information and use a third-party service for processing payments.
7. Your Reviews
By posting Reviews on the Site, you grant us a license to use them for our business purposes. You are responsible for the content of your Reviews and agree not to post misleading or offensive content.
8. Cancellation Policy
Cancellation terms are governed by the applicable policy at the time of booking. MadridTourExperience may cancel bookings at its discretion and will refund accordingly.
9. Rules of the Site
You agree to use the Site for its intended purpose and abide by its rules. Communication with Suppliers should occur through the Site, and personal contact details should not be shared before booking acceptance.
10. Independent Contractor Relationship
Suppliers are independent contractors, and MadridTourExperience does not control their services. Suppliers are responsible for compliance with relevant laws and regulations.
11. Acceptance of Risk and Waiver of Liability
You acknowledge and assume all risks associated with Tours. MadridTourExperience is not liable for any damages or injuries that may occur during Tours.
12. Disclaimer
MadridTourExperience does not control Suppliers’ services and is not liable for any damages resulting from their actions or omissions.
13. Limitation of Liability
Our liability is limited to the amount paid for a booking or $500, whichever is higher.
14. Your Liability and Indemnification
You agree to indemnify MadridTourExperience for any claims arising from your use of the Site or participation in Tours.
15. Release for the Suppliers’ Services
You release Suppliers from liability for any damages arising from Tours and agree to indemnify them for any claims.
16. Intellectual Property
The Site and its content are the property of MadridTourExperience and may not be used without permission.
17. Dispute Resolution
Disputes will be resolved through arbitration, except for small claims court actions. You may opt out of arbitration within 30 days of agreeing to these Terms and Conditions.
18. Litigation Class Action Waiver
You agree not to participate in class action lawsuits against MadridTourExperience.
19. Force Majeure
We are not liable for failure to fulfill obligations due to force majeure circumstances.
20. Amendments to the Terms
